Article 1 – Terminology
Within these General Terms and Conditions, the following definitions shall apply:
Cooling-off period
The legally defined timeframe during which a customer may cancel a distance purchase without giving any reason.
Customer
An individual acting for purposes that do not relate to commercial, business, or professional activities who enters into a distance contract with Helena & June New York.
Calendar day
Any day of the week, including weekends and public holidays.
Ongoing agreement
A distance contract involving repeated or periodic delivery of products or services over a longer period.
Permanent data carrier
Any medium that allows information to be stored in a manner that enables future access and unaltered reproduction.
Withdrawal right
The customer’s legal right to dissolve the agreement within the applicable cooling-off period.
Seller
The natural person or legal entity operating under the name Helena & June New York that offers products or services remotely.
Distance contract
An agreement concluded exclusively through remote communication methods, without physical presence of both parties.
Remote communication method
Any technology used to conclude a contract without in-person contact.

Article 3 – Scope of Application
These Terms apply to all offers, transactions, and distance contracts entered into between Helena & June New York and its customers.
Prior to completing a purchase, customers will be given access to these Terms. If immediate access is not feasible, Helena & June New York will indicate how the Terms can be reviewed electronically and will provide them free of charge upon request.
If specific products or services are subject to additional conditions, the provision most favorable to the customer will prevail in the event of inconsistencies.
Should any clause be found invalid or unenforceable, the remaining provisions will remain in effect. The invalid clause shall be replaced by a provision that most closely reflects the original intention.
Article 4 – Offers and Product Information
Promotions with a limited duration or special conditions will always be clearly identified.
All offers are non-binding. Helena & June New York reserves the right to modify or discontinue offers at any time.
Product descriptions and images aim to provide an accurate representation. Minor deviations in color, design, or appearance may occur due to display or production differences.
Each offer includes clear information regarding:

Article 5 – Contract Formation
A contract is established once the customer completes the order process and confirms acceptance of the offer.
If confirmation is sent electronically, the customer remains free to cancel the order until that confirmation is issued.
Article 6 – Returns and Withdrawal
Non-discounted items may be returned within 30 days of delivery, provided they are unused, undamaged, and returned in their original packaging.
Items purchased during Final Sale promotions — defined as discounts of 40% or more — are excluded from returns, refunds, and exchanges. This condition is clearly stated before purchase.
Article 7 – Return Costs and Refunds
When a return is approved, all return shipping costs are borne by the customer.
Returned products are shipped directly to an international fulfillment partner.
Refunds will be issued within 14 days after receipt of the returned item or valid proof of shipment, including standard outbound shipping costs where applicable.
Article 8 – Return Exceptions
The withdrawal right does not apply to:

Products that cannot be returned for hygiene reasons (e.g. intimate items or earrings)

Article 9 – Pricing Policy
Prices displayed during an active offer period will remain valid unless changes are required due to legal or regulatory obligations.
Article 10 – Product Standards and Warranty
Helena & June New York ensures that delivered products meet reasonable expectations of quality, functionality, and conformity with the agreement.
Article 11 – Shipping and Delivery
Orders are handled with due diligence.
In the event of unforeseen delivery delays, customers will be notified as soon as reasonably possible.
Article 12 – Payments
Unless otherwise agreed, full payment is required at checkout.
Helena & June New York reserves the right to correct errors in pricing, availability, or product information without prior notice.

Article 14 – Applicable Law
These Terms are governed by the laws applicable in the country where Helena & June New York is legally registered, unless mandatory consumer protection laws dictate otherwise.
Statutory consumer rights remain unaffected.
Article 15 – Changes to the Terms
Helena & June New York may revise these Terms from time to time. Customers will be informed at least 30 days before changes take effect.
Article 16 – Shipping and Returns Logistics
Helena & June New York may use international logistics partners. Orders and approved returns may therefore be shipped to and from locations outside the customer’s country.

Return and exchange policies may be updated at any time. Helena & June New York retains final discretion regarding return eligibility, without limiting statutory consumer rights.
